Who determines incapacity in a guardianship?

Only a court can determine that a person is incapacitated and in need of a guardian. Only a court can define the scope and duration of a guardian’s authority. A court makes this determination based on a review of a Certificate of Medical Examination made by a licensed physician and a hearing with the ward and the ward’s attorney ad litem and the prospective guardian and prospective guardian’s attorney.
